$250,000 Verdict for Bus Passenger

A Fairfax County, Virginia jury has awarded a 74 year old wheelchair bound passenger $250,000 for injuries she sustained when her wheelchair fell over during a trip.
The plaintiff claimed she sustained fractures to her face and femoral neck and that the femoral neck fracture could not be surgically repaired.

The plaintiff's claim was that she would require narcotic medication for the rest of her life to contend with the hip pain.
The defendant agreed that it was negligent but contended this was "no big deal" and that she had some of her injuries before the accident. It also contended that she did not complain of pain during some of her office visits.

Teaching points:
Even a conservative jurisdiction like Fairfax will provide fair compensation when the plaintiff has real injuries. I'm sure it didn't help much that the bus company tried to downplay this lady's injuries. As will typically happen, this backfires when the jury thinks the plaintiff is not lying or over-reacting to her injuries.

As with all verdicts reported in this blog, this is for information only. Your case is certainly different and the fact that a case settled or was awarded a certain amount of money does not guarantee that another jury will do the same later.
