Teen Faces 10 Years for High Speed Death

A local teenager, who was 17 at the time of the accident, was convicted of involuntary manslaughter yesterday in Arlington Circuit Court. Apparently, evidence at trial was that she attained speeds in excess of 100 MPH on the George Washington Parkway.

One youth was killed and one other very seriously injured.

The young driver now faces up to 10 years in the state penitentiary and she's in front of a no non-sense judge. In fact, denied bail and put her in jail immediately.

Tragic case obviously. She was not only driving in gross violation of the speed laws, but it was after midnight, when teens in Virginia aren't allowed to be driving.

Interestingly, the evidence at trial (in fact, this was her "defense") was that the others in the car were egging her on (she had 4 months driving experience) to "go faster," and "break records."

Virginia law generally bars recovery in civil court for personal injury damages for someone who "assumes the risk" of injuries. It will be interesting to see whether in car insurance company who insured the car/driver will assert that the passenger who allegedly "egged her on" thus "assumed the risk" of death or injury.
