I thought the insurance companies had stopped the practice I am about to describe but maybe I've just been missing it. I call it the "don't worry, we'll cover everything and give you a little for pain and suffering" gambit. Here's how it works:
You get into an auto accident and the person who hit you is clearly responsible. You spend some time in the emergency department and start treatment with your own doctor. The insurance adjuster swoops in, by phone and by mail, and promises to "pay your medical bills" and give you a $1,000 to $1,500 for your 'pain and suffering."
Good Deal?
Never. The problem is that there is no way to tell, within a couple of weeks of an accident, whether your condition will worsen or take a prolonged time for recovery. You may well recover shortly and it may be a decent deal in the end but you can't know that early on.
There is no rush, folks, to settle cases (and we are critical of lawyers who promise "quick settlements in 30 days or less." )
I've seen this happen no less than five times in the last 42 days. The insurance companies reportedly were State Farm, Geico, Allstate and Nationwide.
Here's what happened to the one lady who fell for the trick. She called me months after her accident wanting to get out of one of these settlements after her injuries got worse and now she needed surgery.
Guess what? She can't. The papers she signed (I reviewed them for her) said that this was a full and final settlement of her claim. She couldn't go back now.
