One More Way to "Lose" a Malpractice Case

Malpractice cases must be virtually "perfect" in Virginia to win. Now here's another way to "lose" one. Have the large, 45 doctor specialty practice buy insurance from a company that was not licensed in Virginia and is now out of business. At least that's the story out of Hampton Roads, Virginia, today.

The Virginia Pilot exposed this travesty today. Now, you might think that Virginia law would protect a patient from something like happening. You might think that we might REQUIRE insurance or at least make sure that those selling it are licensed here. But no, according to the Virginia-Pilot:


An investigation found nothing in Virginia law or policy that would prevent such a situation from occurring again. "It was an extremely unpleasant situation for everyone involved in it," said Dr. Linda Long, one of the defendants, "including the physicians, who had paid their premiums, done what they were supposed to do and were told that the rug was being pulled out from under them

Kinda makes you real comfortable, doesn't it?
