Secret Malpractice Settlements

Whenever you see see doctors pushing for "malpractice reform" or "tort reform" you should call your legislature and ask her to ask this question when the doctors come calling:

Doctor, before we sit down to discuss what it is you want me to do for you, will you release the claim information on every claim you have paid and will you encourage your colleagues to do the same?

You see, the doctors don't want you to hear the horror stories because in 100% of the cases that are settled the doctors insist on a secrecy agreement that prevents the patient from ever talking about the case again. Many of these clauses contain penalties which say that the patient would repay the money he just received if word of the settlement leaks out.

How fair is it to debate the issue of malpractice reform by preventing one side from talking?
