West Virginia Man Files Medical Malpractice Suit Against Family Physician

A man from Jackson County, West Virginia has filed a medical
malpractice suit against a family physician alleging that he became disabled as
a result of her misdiagnosis.
On July 23, Gary Jones filed suit against Dr. Sandra Brannin, a physician in Charleston, West
Virginia, in the Kanawha County, West Virginia
Circuit Court. Richard Brannin, a physical therapist and Brannin’s husband, was
also named as a defendant.
On November 1, 2006, Jones saw Brannin complaining of neck
pain, tingling, and weakness in his left hand. She saw him again on November 22
for pain in his left shoulder.
The suit alleges that Jones was misdiagnosed with a torn
rotator cuff and improperly treated by Brannin, who then referred Jones to her
husband, a physical therapist.
Jones alleges that after months of undergoing physical
therapy, he saw Dr. William Sale, who diagnosed him with a large herniated
disc.
According to the suit, Jones developed a “severe and
permanent tremor” in his left arm, causing him to be disabled, because of
Brannin’s improper care and treatment.
Jones alleges that he was then referred to Brannin’s husband with no proper diagnosis
and that Brannin had financial interest in referring him to her husband.
Jones’ wife, Brandy Jones, has also been named as a plaintiff and claims that
she suffered irreparable loss and loss of comfort, society, convenience, and
consortium from her husband.
The Jones’ are seeking compensatory and punitive damages.
