In most cases of civil litigation, you are not allowed access to your opponent's files and documents until litigation starts. Denial of employer sponsored disability claims are different, yet most claimants don't take full advantage of the law.

If your disability benefits are denied, or benefits that are being paid are terminated, the very first thing you should do is to request your claim file. I am shocked by how many people come to me, after exhausting their administrative appeals, yet they have never requested the claim file! Insurance companies are legall required to TELL you that you have this right, yet some don't.

If your disability benefits have been terminated or denied, you really should seek the services of an experienced disability insurance attorney. One federal judge said that claimiants who don't get good legal advice BEFORE pursuing an administrative appeal often find themselves at a distinct disadvantage when they have to file suit against the insurance company.
