Three recent encounters with potential new clients show that the automobile insurance companies are still up to their old tricks. While big business and many in government continually try to demonize trial lawyers the insurance companies will stop at nothing to rip people off. Make no mistake about it, big business and the giant insurance companies want to make sure that you go into the settlement of your accident claim with as little information as possible.

In two cases potential clients called me shortly after their car accidents. In each case the insurance company had tried to get them to settle their cases the DAY AFTER THE ACCIDENT for $1,000 and a promise to pay related medical bills for six months. In one of the cases the victim had suffered a serious head injury, told the insurance company to not bother her, yet they called her TWO MORE TIMES in the next seven days.

In the third case I got this desperate email from a third victim. Here it is verbatim

Dear Mr. Glass:

Can you help me? I was involved in a car accident six months ago. The insurance company contacted me the day after the accident and promised to "take care of me" if i would sign a form letting them have my medical records. I signed their form and after two weeks of treatment they told me that my injury was not serious and would get better in the next four weeks. They offered to pay my medical bills for the next month and $!,000 for my pain and suffering.

Stupidly, I signed their release.

Unfortunately my pain did not go away, and yesterday I had neck surgery. I would like to sue the driver who caused the accident and the insurance company for having me sign their form. Can you help me?

Unfortunately there is not much you can do once you sign the insurance company release.

Look, I'm one who doesn't think that every case needs a lawyer or that you need to immediately hire a lawyer to represent you for your case, as some ads suggest. I do think, however, that you need to be smart about this. At least read Five Deadly Sins That Can Wreck Your Accident Case. At the very least, consult with a lawyer. It would be well worth your time and money to pay a lawyer just to consult on your case, even if it appears to be a small case.

Remember, once you sign that insurance company release, there is no going back.
